For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. Dear all:
May I ask what I should do in the following situation?
I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.
That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

Currently I am working for employer A on H1B. I have applied for I-485 and have EAD. I have one permanent opprtunity from a consulting firms B. Compnay B is asking me to join on EAD. But threir current client is in Canada. So compnay B want me to travel to Canada, every week, retun back to US in week end. Can I do this while working on EAD. I am just worried wether it will cause any problem. They told that that is the reason they do not want to do H1B.

I am fortunate enough to have a pretty good arts and sports immigration practice. I've met a lot of really talented people from both fields over the years. Hi,
My current employer filed my labor and 140 in 2007 under EB3 and are also approved. Now I am planning to move to a different who is willing to start my GC under EB2. Now can i use 2007 as my priority date?

How is IT sector doing these days. I am hearing from friends that IT folks are generally getting jobs. But it is only banking sector that is very bad. Which IT areas are in bad shape?
Have the salaries gone down?

I am really unclear about the whole process of the i-90. My situation as whole is unclear to
me. I gave a call to the USCIS to find out my status since i recieved my welcome letter by mail only to find out that my green card has been mailed back by usps and labeled "undeliverable". I dont know exactly what happen but i already started an i-90. If i wanted to travel outside the US, what would i need? I have seen people suggesting getting an i-551 stamp. But those people were renewing their green card. Would my situation be different as I actually never held a green card. Would they still stamp
my passport so i can travel out of the country or would there be other ways to?

Hi,
I have filed my 485 on July 2007. I am currently working using EAD and last time entered US in Feb 09 using AP. My current AP is valid till Oct 17 2009. I will be going out of the country for few days in early Sep. I wanted to know can I apply for my renewal of AP now. I read the following in the I-131 filing instructions (page-4)
If you travel before the advanced parole document is issued, your application will be deemed abandoned if:
1. You depart the United States; or
2. The person seeking advance parole attempts to enter the United States before a decision is made on the application
So can I apply for my AP renewal now (I am assuming if I apply now it won't get approved before my travel in Sep) or do I need to first complete my travel in Sep, come back to US and then apply for the renewal.
Please reply.

Guys,
I need to find out what documents I need to send after I file I-765 online. DO anyone has the experience in this matter. I filed my I-485 and at tht time i did not filed my I756 just to avoid lawyer's fee.
The form says I need to send a copy of I-94 and photo thats all, but the confirmation notice I received after filing the form online said that do not send any photo's or any identification document and the notice said that they will sent me a Biometric appointment.
DO anyone has info on this
